Current U.S. Bail Laws
Bail laws in the United States today were originally enacted in 1984 and are covered under United States Code, Title 18, Sections 3141-3150. These laws replaced the previous bail laws covered in the Bail Reform Act of 1966, which faced a lot of criticism because of its perceived leniency on criminal offenders.
The current laws regarding the release and detention of defendants pending judicial proceedings are clear and specific regarding who can and cannot be released and what types of offenders will be denied bail. Whereas many defendants were previously released on their own recognizance even if they were a danger to society, new laws set forth specific qualifications for a person to qualify.
In addition, some offenders may not even be eligible for bail at all. All Capital Felony offenders are not eligible for bail. This includes such crimes as murder, terrorism and other especially violent crimes which are punishable by the death penalty. Additional offenses not eligible for bail include:
- Violent crimes
- Crimes which are punishable by 10 years or more in prison
- Crimes which are punishable by life in prison or the death penalty
- Any felony committed if the accused previously committed two or more offenses listed above.
There are other factors which will be taken into consideration:
- If the defendant is a possible danger to society.
- If the defendant is likely to flee.
